Introduction and Scope<\/strong><\/h2>\n<p data-start=\"229\" data-end=\"497\">This document establishes the general terms and conditions of sale (hereinafter, &#8220;Terms and Conditions&#8221;) that govern the access and use of the <strong data-start=\"394\" data-end=\"413\">casarossa.it<\/strong> website (hereinafter, the &#8220;Site&#8221;) and the purchase of the products offered through it.<\/p>\n<p data-start=\"499\" data-end=\"747\">The Site is owned and managed by <strong data-start=\"535\" data-end=\"553\">Societ\u00e0 Agricola Casa Rossa S.S.<\/strong>, tax code and VAT <strong data-start=\"629\" data-end=\"647\">number 03115810842<\/strong>, registered in the <strong data-start=\"687\" data-end=\"715\">Agrigento<\/strong> Business Register (hereinafter, the &#8220;Seller&#8221;).<\/p>\n<p data-start=\"749\" data-end=\"975\">Access to and use of the Site, as well as the purchase of products for sale, imply full acceptance of these <strong data-start=\"870\" data-end=\"894\">Terms and Conditions<\/strong>, which the customer is required to read carefully before placing an order.<\/p>\n<h3 data-start=\"977\" data-end=\"1001\"><strong data-start=\"981\" data-end=\"1001\">1.1. Definitions <\/strong><\/h3>\n<p data-start=\"1002\" data-end=\"1051\">For the purposes of this document, the following definitions shall apply:<\/p>\n<ul data-start=\"1052\" data-end=\"1905\">\n<li data-start=\"1052\" data-end=\"1149\"><strong data-start=\"1054\" data-end=\"1067\">&#8220;Customer&#8221;<\/strong>: any natural or legal person who purchases products through the Site.<\/li>\n<li data-start=\"1150\" data-end=\"1387\"><strong data-start=\"1152\" data-end=\"1169\">&#8220;Consumer&#8221;<\/strong>: any natural person who makes a purchase for purposes unrelated to his or her trade, business or professional activity, pursuant to <strong data-start=\"1321\" data-end=\"1384\">the Consumer Code (Legislative Decree 206\/2005 and subsequent amendments).<\/strong><\/li>\n<li data-start=\"1388\" data-end=\"1489\"><strong data-start=\"1390\" data-end=\"1405\">&#8220;Seller&#8221;<\/strong>: <span style=\"font-weight: bolder;\" data-start=\"535\" data-end=\"553\">Societ\u00e0 Agricola Casa Rossa S.S.,<\/span> owner of the Site and responsible for the sale of the products.<\/li>\n<li data-start=\"1490\" data-end=\"1610\"><strong data-start=\"1492\" data-end=\"1506\">&#8220;Products&#8221;<\/strong>: all items for sale on the Site, in particular extra virgin olive oil and similar products.<\/li>\n<li data-start=\"1611\" data-end=\"1736\"><strong data-start=\"1613\" data-end=\"1625\">&#8220;Order&#8221;<\/strong>: the purchase request submitted by the Customer through the Site, following the checkout procedure provided.<\/li>\n<li data-start=\"1737\" data-end=\"1905\"><strong data-start=\"1739\" data-end=\"1765\">&#8220;Sales Contract&#8221;<\/strong>: the legally binding agreement between the Seller and the Customer, which is finalized with the confirmation of the order by the Seller.<\/li>\n<\/ul>\n<h3 data-start=\"1907\" data-end=\"1942\"><strong data-start=\"1911\" data-end=\"1942\">1.2. Scope <\/strong><\/h3>\n<p data-start=\"1943\" data-end=\"2207\">These <strong data-start=\"1955\" data-end=\"1979\">Terms and Conditions<\/strong> apply to all product sales made through the Site.<\/p>\n<p data-start=\"2209\" data-end=\"2488\">The Seller reserves the right to modify these terms and conditions of sale at any time, without prior notice. However, any changes will only be applicable to orders placed after the publication of the new conditions on the Site. <\/p>\n<p data-start=\"2490\" data-end=\"2669\">By placing an order on the Site, the Customer <strong data-start=\"2533\" data-end=\"2585\">declares that he has read and accepted<\/strong> these <strong data-start=\"2598\" data-end=\"2622\">Terms and Conditions<\/strong> in full, without the need for a specific paper signature.<\/p>\n<p data-start=\"2671\" data-end=\"2882\">For any questions about the Terms and Conditions, the Customer can contact customer service at the email address <strong data-start=\"2785\" data-end=\"2817\">info@casarossa.it<\/strong><\/p>\n<p data-start=\"2671\" data-end=\"2882\">\n<h2 data-start=\"117\" data-end=\"153\"><strong data-start=\"120\" data-end=\"151\">2. Products and Availability<\/strong><\/h2>\n<h3 data-start=\"155\" data-end=\"194\"><strong data-start=\"159\" data-end=\"192\">2.1. Description of the Products <\/strong><\/h3>\n<p data-start=\"195\" data-end=\"447\">Information on the products available for purchase can be found directly on the dedicated page of the Website, accessible at the following link: <a href=\"https:\/\/casarossa.it\/store\/\" target=\"_new\" rel=\"noopener\" data-start=\"351\" data-end=\"409\">https:\/\/casarossa.it\/store\/<\/a> (hereinafter, the &#8220;Products Page&#8221;).<\/p>\n<p data-start=\"449\" data-end=\"859\">The Vendor undertakes to provide accurate and detailed descriptions for each item, however the images on the Site are for illustrative purposes only and may not faithfully represent the characteristics of the product received. Any aesthetic differences that do not compromise the quality and essential characteristics of the product will not be considered defects of conformity. <\/p>\n<h3 data-start=\"861\" data-end=\"902\"><strong data-start=\"865\" data-end=\"900\">2.2. Availability of Products <\/strong><\/h3>\n<p data-start=\"903\" data-end=\"1139\">The Vendor endeavours to keep product availability information up to date, however actual availability may change without notice due to concurrent orders or other unforeseen circumstances.<\/p>\n<p data-start=\"1141\" data-end=\"1424\">In the event that a purchased product is <strong data-start=\"1191\" data-end=\"1239\">not available after the order has been confirmed<\/strong>, the Customer will be promptly informed by email or other means of communication provided at the time of purchase. In this case, the Customer may choose from the following options: <\/p>\n<ul data-start=\"1426\" data-end=\"1760\">\n<li data-start=\"1426\" data-end=\"1617\"><strong data-start=\"1428\" data-end=\"1470\">Full refund of the amount paid<\/strong>, which will be made within a maximum period of <strong data-start=\"1521\" data-end=\"1573\">15 days<\/strong> from the notification of unavailability.<\/li>\n<li data-start=\"1618\" data-end=\"1760\"><strong data-start=\"1620\" data-end=\"1668\">Issuance of a discount code of equal value<\/strong>, which can be used for future purchases on the Site, based on the preferences expressed by the Customer.<\/li>\n<\/ul>\n<p data-start=\"1762\" data-end=\"1960\">In any case, the Vendor will not be liable for any delays in the return of the amount due to banking procedures or payment intermediaries independent of its management.<\/p>\n<p data-start=\"1962\" data-end=\"2186\">The Vendor also reserves the right to modify, replace or remove products from the catalog at any time, without prior notice. However, these changes will not affect orders that have already been confirmed. <\/p>\n<p data-start=\"1962\" data-end=\"2186\">\n<h2 data-start=\"125\" data-end=\"167\"><strong data-start=\"128\" data-end=\"165\">3. Prices and Payment Methods<\/strong><\/h2>\n<h3 data-start=\"169\" data-end=\"203\"><strong data-start=\"173\" data-end=\"201\">3.1. Prices of the Products <\/strong><\/h3>\n<p data-start=\"204\" data-end=\"454\">The prices of the products are indicated in <strong data-start=\"243\" data-end=\"255\">Euros (\u20ac)<\/strong> and include <strong data-start=\"278\" data-end=\"285\">VAT<\/strong>, according to the applicable rate in force at the time of purchase. The price of each product is specified on the relevant detail page within the Site. <\/p>\n<p data-start=\"456\" data-end=\"668\">The Seller reserves the right to change prices at any time, without prior notice. However, the applicable price will be the one in force at the time of confirmation of the order by the Customer. <\/p>\n<p data-start=\"670\" data-end=\"934\">In the event of an obvious error in the indication of the price of a product on the Site, the Vendor reserves the right to cancel the order before shipment, promptly informing the Customer and proceeding with the refund of any amount already paid.<\/p>\n<h3 data-start=\"936\" data-end=\"972\"><strong data-start=\"940\" data-end=\"970\">3.2. Payment Methods <\/strong><\/h3>\n<p data-start=\"973\" data-end=\"1255\">The Customer can only make payment through the payment methods specified during checkout<b> <\/b>of the Site. Transactions take place through a secure and encrypted payment platform, which guarantees the protection of the Customer&#8217;s sensitive data. <\/p>\n<p data-start=\"1257\" data-end=\"1449\">The Seller does not store or have access to the payment card data entered by the Customer, as the payment process is managed directly by the payment service provider.<\/p>\n<p data-start=\"1451\" data-end=\"1697\">The total amount of the order is debited at the time of confirmation of the purchase. In the event of a refusal or error in the transaction, the order will not be processed and the Customer will be asked to repeat the payment in a valid manner. <\/p>\n<p data-start=\"1699\" data-end=\"1866\">The Vendor reserves the right to cancel an order or request additional security checks in the event that an anomaly is detected in the transaction.<\/p>\n<p data-start=\"1699\" data-end=\"1866\">\n<h2 data-start=\"143\" data-end=\"203\"><strong data-start=\"146\" data-end=\"201\">4. Purchase Methods and Conclusion of the Contract<\/strong><\/h2>\n<h3 data-start=\"205\" data-end=\"241\"><strong data-start=\"209\" data-end=\"239\">4.1. Purchase Procedure <\/strong><\/h3>\n<p data-start=\"242\" data-end=\"510\">To place an order on the Site, the Customer must follow the <strong data-start=\"304\" data-end=\"335\">online purchase process<\/strong>, selecting the desired products and adding them to the cart. Once the selection has been completed, the Customer can access the checkout page, where they will be required to: <\/p>\n<ul data-start=\"512\" data-end=\"767\">\n<li data-start=\"512\" data-end=\"578\">Enter the necessary billing and shipping information.<\/li>\n<li data-start=\"579\" data-end=\"632\">Select the available payment method.<\/li>\n<li data-start=\"633\" data-end=\"717\">Agree to these <strong data-start=\"656\" data-end=\"680\">Terms and Conditions<\/strong> and the <strong data-start=\"685\" data-end=\"714\">Privacy Policy<\/strong>.<\/li>\n<li data-start=\"718\" data-end=\"767\">Confirm the order and proceed to payment.<\/li>\n<\/ul>\n<p data-start=\"769\" data-end=\"1121\">At the end of the procedure, the Customer will receive an <strong data-start=\"829\" data-end=\"853\">order confirmation<\/strong> email, containing a summary of the items purchased, the total price, the shipping address and the payment method used. This email represents a simple confirmation of receipt of the order and <strong data-start=\"1061\" data-end=\"1118\">does not constitute acceptance of the sales contract<\/strong>. <\/p>\n<h3 data-start=\"1123\" data-end=\"1190\"><strong data-start=\"1127\" data-end=\"1188\">4.2. Acceptance of the Order and Conclusion of the Contract <\/strong><\/h3>\n<p data-start=\"1191\" data-end=\"1405\">The sales contract between the Client and the Seller is considered concluded only when the Seller processes the order and begins the shipping process of the purchased goods.<\/p>\n<p data-start=\"1407\" data-end=\"1497\">The Seller reserves the right to refuse or cancel an order in the following cases:<\/p>\n<ul data-start=\"1498\" data-end=\"1846\">\n<li data-start=\"1498\" data-end=\"1568\"><strong data-start=\"1500\" data-end=\"1532\">Unavailability of the product<\/strong> (as specified in clause 2.2).<\/li>\n<li data-start=\"1569\" data-end=\"1632\"><strong data-start=\"1571\" data-end=\"1629\">Non-payment or unsuccessful transaction<\/strong>.<\/li>\n<li data-start=\"1633\" data-end=\"1701\"><strong data-start=\"1635\" data-end=\"1698\">Obvious error in the price or description of the product<\/strong>.<\/li>\n<li data-start=\"1702\" data-end=\"1761\"><strong data-start=\"1704\" data-end=\"1758\">Orders that have anomalies or suspicions of fraud<\/strong>.<\/li>\n<li data-start=\"1762\" data-end=\"1846\"><strong data-start=\"1764\" data-end=\"1806\">Incomplete or incorrect shipping data<\/strong> preventing proper delivery.<\/li>\n<\/ul>\n<p data-start=\"1848\" data-end=\"2098\">In the event of cancellation of the order for one of the reasons indicated above, the Customer will be promptly informed and will receive a <strong data-start=\"1975\" data-end=\"2035\">full refund of any amount already paid<\/strong>, according to the payment methods used for the purchase.<\/p>\n<h3 data-start=\"2100\" data-end=\"2171\"><strong data-start=\"2104\" data-end=\"2169\">4.3. Modification or Cancellation of the Order by the Client <\/strong><\/h3>\n<p data-start=\"2172\" data-end=\"2469\">Once your order is confirmed, <strong data-start=\"2203\" data-end=\"2243\">you can&#8217;t make any changes<\/strong> to the selected items or shipping information. However, if the order has not yet been processed, the Customer can contact customer service at <strong data-start=\"2403\" data-end=\"2435\">info@casarossa.it<\/strong> to request a change or cancellation. <\/p>\n<p data-start=\"2471\" data-end=\"2626\">The Vendor does not guarantee the possibility of cancelling the order once confirmed, as the logistics management may have already been started.<\/p>\n<p data-start=\"2471\" data-end=\"2626\">\n<h2 data-start=\"116\" data-end=\"149\"><strong data-start=\"119\" data-end=\"147\">5. Shipping and Delivery<\/strong><\/h2>\n<h3 data-start=\"151\" data-end=\"221\"><strong data-start=\"155\" data-end=\"219\">5.1. Shipping Costs and Free Shipping Threshold <\/strong><\/h3>\n<p data-start=\"222\" data-end=\"513\">Shipping costs are calculated at checkout and vary according to the weight, destination and delivery methods selected. The <strong data-start=\"377\" data-end=\"414\">threshold for free shipping<\/strong> is indicated on the product detail page and may be subject to change without notice. <\/p>\n<h3 data-start=\"515\" data-end=\"564\"><strong data-start=\"519\" data-end=\"562\">5.2. Preparation and Shipping Times <\/strong><\/h3>\n<p data-start=\"565\" data-end=\"761\">The Vendor undertakes to prepare and ship orders within <strong data-start=\"628\" data-end=\"653\">1-5 working days<\/strong> of receipt of payment, in the event that the products are <strong data-start=\"718\" data-end=\"758\">physically available in stock<\/strong>.<\/p>\n<p data-start=\"763\" data-end=\"961\">In exceptional situations or force majeure, preparation times may be <strong data-start=\"862\" data-end=\"876\">longer<\/strong>. In this case, the Customer will be informed promptly and will have the opportunity to: <\/p>\n<ul data-start=\"962\" data-end=\"1083\">\n<li data-start=\"962\" data-end=\"1011\"><strong data-start=\"964\" data-end=\"1008\">Wait for the new shipping deadline<\/strong>,<\/li>\n<li data-start=\"1012\" data-end=\"1083\"><strong data-start=\"1014\" data-end=\"1080\">Request the cancellation of the order with a full refund<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"1085\" data-end=\"1285\">Delivery times vary depending on the destination and the courier used. The Seller is not responsible for any delays in delivery caused by the courier or unforeseen circumstances. <\/p>\n<h3 data-start=\"1287\" data-end=\"1322\"><strong data-start=\"1291\" data-end=\"1320\">5.3. Delivery Methods <\/strong><\/h3>\n<p data-start=\"1323\" data-end=\"1507\">Delivery is made <strong data-start=\"1352\" data-end=\"1389\">to the address provided by the Customer<\/strong> at the time of ordering. It is the Customer&#8217;s responsibility to verify that the shipping information is correct and complete. <\/p>\n<p data-start=\"1509\" data-end=\"1761\">In the event of the recipient&#8217;s absence, the courier will make <strong data-start=\"1569\" data-end=\"1605\">a second delivery attempt<\/strong>. If the second attempt is also unsuccessful, the package can be kept in storage at the courier&#8217;s depot for a limited time. <\/p>\n<h3 data-start=\"1763\" data-end=\"1814\"><strong data-start=\"1767\" data-end=\"1812\">5.4. Storage Costs and Non-Delivery <\/strong><\/h3>\n<p data-start=\"1815\" data-end=\"2020\">If the delivery does not take place for reasons <strong data-start=\"1852\" data-end=\"1883\">not attributable to the Seller<\/strong> (e.g. wrong address, absent recipient, failure to collect from the courier&#8217;s warehouse within the established deadlines), the costs deriving from:<\/p>\n<ul data-start=\"2021\" data-end=\"2093\">\n<li data-start=\"2021\" data-end=\"2038\"><strong data-start=\"2023\" data-end=\"2035\">Stock<\/strong>,<\/li>\n<li data-start=\"2039\" data-end=\"2064\"><strong data-start=\"2041\" data-end=\"2061\">Non-delivery<\/strong>,<\/li>\n<li data-start=\"2065\" data-end=\"2093\"><strong data-start=\"2067\" data-end=\"2090\">Return to sender<\/strong>,<\/li>\n<\/ul>\n<p data-start=\"2095\" data-end=\"2142\">will be <strong data-start=\"2103\" data-end=\"2139\">entirely borne by the Customer<\/strong>.<\/p>\n<p data-start=\"2144\" data-end=\"2189\">In this case, the Customer will be able to choose whether:<\/p>\n<ol data-start=\"2190\" data-end=\"2387\">\n<li data-start=\"2190\" data-end=\"2268\"><strong data-start=\"2193\" data-end=\"2232\">Pay the reshipping costs<\/strong> to receive the package again.<\/li>\n<li data-start=\"2269\" data-end=\"2387\"><strong data-start=\"2272\" data-end=\"2296\">Get a refund<\/strong> of the amount paid, <strong data-start=\"2318\" data-end=\"2384\">minus shipping, storage and return costs<\/strong>.<\/li>\n<\/ol>\n<p data-start=\"2389\" data-end=\"2587\">The Seller assumes no responsibility for delays or non-delivery due to errors in the address provided by the Customer or other external factors beyond its control.<\/p>\n<p data-start=\"2389\" data-end=\"2587\">\n<h2 data-start=\"120\" data-end=\"157\"><strong data-start=\"123\" data-end=\"155\">6. Right of Withdrawal and Returns<\/strong><\/h2>\n<h3 data-start=\"159\" data-end=\"207\"><strong data-start=\"163\" data-end=\"205\">6.1. Exclusion of the Right of Withdrawal <\/strong><\/h3>\n<p data-start=\"208\" data-end=\"436\">Under the<strong data-start=\"222\" data-end=\"313\">Article 59, letters d) and e) of the Consumer Code (Legislative Decree 206\/2005 and subsequent amendments)  <\/strong>, the right of withdrawal <strong data-start=\"337\" data-end=\"355\">does not apply<\/strong> to purchases made on the Site, as the products sold fall between:<\/p>\n<ul data-start=\"437\" data-end=\"601\">\n<li data-start=\"437\" data-end=\"540\"><strong data-start=\"439\" data-end=\"537\">Sealed goods that cannot be returned for health and hygiene reasons once opened<\/strong>.<\/li>\n<li data-start=\"541\" data-end=\"601\"><strong data-start=\"543\" data-end=\"598\">Goods subject to rapid deterioration or alteration<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"603\" data-end=\"816\">For this reason, the Client <strong data-start=\"631\" data-end=\"680\">cannot exercise the right of reconsideration<\/strong> and there is no return for a product exchange or for any other reason not related to a defect or error on the part of the Seller.<\/p>\n<h3 data-start=\"818\" data-end=\"882\"><strong data-start=\"822\" data-end=\"880\">6.2. Return for Damaged, Defective or Incorrect Product <\/strong><\/h3>\n<p data-start=\"883\" data-end=\"896\">In the event of:<\/p>\n<ul data-start=\"897\" data-end=\"1052\">\n<li data-start=\"897\" data-end=\"947\"><strong data-start=\"899\" data-end=\"944\">Product damaged during transport<\/strong>,<\/li>\n<li data-start=\"948\" data-end=\"975\"><strong data-start=\"950\" data-end=\"972\">Defective product<\/strong>,<\/li>\n<li data-start=\"976\" data-end=\"1052\"><strong data-start=\"978\" data-end=\"1049\">Shipping error (product received different from the one ordered),<\/strong><\/li>\n<\/ul>\n<p data-start=\"1054\" data-end=\"1228\">the Customer must contact customer service no later than <strong data-start=\"1119\" data-end=\"1129\">48 hours<\/strong> after receiving the package, by sending an email to <strong data-start=\"1189\" data-end=\"1221\">the info@casarossa.it<\/strong> address with:<\/p>\n<ul data-start=\"1229\" data-end=\"1358\">\n<li data-start=\"1229\" data-end=\"1253\"><strong data-start=\"1231\" data-end=\"1250\">Order number<\/strong>.<\/li>\n<li data-start=\"1254\" data-end=\"1312\"><strong data-start=\"1256\" data-end=\"1309\">Photos of the product received and any damage<\/strong>.<\/li>\n<li data-start=\"1313\" data-end=\"1358\"><strong data-start=\"1315\" data-end=\"1355\">Description of the problem you are experiencing<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"1360\" data-end=\"1493\">The Seller reserves the right to request additional photographic or other evidence to verify the reported problem.<\/p>\n<p data-start=\"1495\" data-end=\"1704\">If the return is <strong data-start=\"1512\" data-end=\"1548\">authorized by customer service<\/strong>, the Customer must return the product in its original condition, with <strong data-start=\"1622\" data-end=\"1701\">intact packaging and complete with all accessories and attached documentation<\/strong>.<\/p>\n<h3 data-start=\"1706\" data-end=\"1744\"><strong data-start=\"1710\" data-end=\"1742\">6.3.
